Judge Strikes Down Biden's Rewrite
Some of Wisconsin’s Republican congressmen are among the loudest voices for women’s sports.
A federal judge in Kentucky on Thursday struck down the Biden Administration’s Title IX rewrite, which added gender and LGBTQ protections into the federal law designed to give women equal protection and equal treatment at schools and universities.
Judge Danny C. Reeves of the U.S. District Court for the Eastern District of Kentucky wrote in his ruling that Biden's changes "fatally taint" Title IX.
“Put simply, there is nothing in the text or statutory design of Title IX to suggest that discrimination ‘on the basis of sex’ means anything other than it has since Title IX’s inception—that recipients of federal funds under Title IX may not treat a person worse than another similarly-situated individual on the basis of the person’s sex, i.e., male or female,” the judge added.
The ruling ends the bid from out-going President Joe Biden to expand the scope of Title IX, and expand what he’s called needed protections for gay and non-binary students.
Wisconsin Republican Congressman Glenn Grothman said the decision means women won’t have to share their sports with men, and women will have their own spaces in schools and at universities.
"Big win for women and girls across the country! Today, a federal judge struck down the Biden Admin’s unprecedented dismantling of Title IX. The court's order is a resounding victory for the rights and protections of women," Grothman wrote on Twitter.
Western Wisconsin's Republican congressman, Derrick Van Orden, said every school in Wisconsin that adopted Biden's Title IX changes needs to change back immediately.
"[It's] Time for this garbage to stop," he said on Twitter. "We must protect women’s sports."
Green Bay Republican Congressman Tony Wied also took to Twitter to say girls and women athletes should celebrate the news.
"A huge win for women and girls everywhere!" he wrote. "The fact that this was even a possibility is absolute madness. It's common sense that men have no place in women's spaces."
Wisconsin’s two Democratic members of Congress, Milwaukee's Gwen Moore and Madison’s Mark Pocan, were silent after the ruling.
